Landmark Fire Safety Prosecution

As a business owner, ask yourself "What do I risk losing if the premises go up in flames?  What more do I risk losing if the authorities prosecute me if I don't meet the standards required?".

Unfortunately the owner of the Chumleigh Lodge Hotel chose to ignore these obligations, and has been fined £210 000.

Information about a business owner's responsibilities in relation to fire has been available since the Reform Order for Fire was announced in 2006.  In a nutshell...

"The Regulatory Reform (Fire Safety) Order 2005 applies to all non-domestic premises in England and Wales, including the common parts of blocks of flats and houses in multiple occupation (HMOs). The law applies to you if you are:

  • responsible for business premises
  • an employer or self-employed with business premises
  • responsible for a part of a dwelling where that part is solely used for business purposes
  • a charity or voluntary organisation
  • a contractor with a degree of control over any premises
  • providing accommodation for paying guests"

This is the tip of the iceberg.  Fire safety is a continuous process, with the ultimate aim 0f protecting staff and premises users from the effects of fire.  By making sure that the building users are safe will go a long way to making sure that the business itself is protected.
